Effective date: October 21, 2026 · Version: 1.0
Nearbidly is an online platform that lets local and national businesses run free-to-bid public auctions. This policy explains:
- what personal information we collect;
- how we use and share it;
- how long we keep it;
- the choices and rights you have.
It applies to nearbidly.com, every auction page hosted on Nearbidly (including *.nearbidly.com pages and business-branded auction pages "Powered by Nearbidly"), our text and email alerts, and our related services (together, the "Service").
1. Who we are
The Service is operated by Local Growth System LLC, a New York company doing business as Nearbidly ("Nearbidly", "we", "us"). Our mailing address is 54 State Street, Ste 804 #16621, Albany, NY 12207. You can reach us at support@nearbidly.com.
Nearbidly and the business running the auction are separate
Every auction is run by an independent business that is the seller of the prize, such as a home-services company, a salon or an agency. We call it the "Business". Its name is shown on the auction page.
| Who | What they are responsible for |
|---|---|
| Nearbidly | Your Nearbidly bidder account, sign-up codes, auction alerts, the bidding system, fraud prevention, and our own analytics. For these, we decide how your information is used. |
| The Business | Its own follow-up with you, such as your free participation gift, offers, scheduling and service delivery, and the payment you make to it. When we send follow-up messages for the Business through its own phone number and email, we act on its instructions as its service provider (processor). The Business's own privacy policy also applies to the information it holds. |
Payments for prizes and offers go directly to the Business through Stripe. Nearbidly never receives or stores your full card details.
2. Information we collect
2.1 Information you give us
- Registration details: first name, last name, mobile phone number, email address, and ZIP code. For some auctions we also ask for a street or shipping address, used to check eligibility and for delivery.
- Consents and eligibility: your agreement to receive texts and emails, and your confirmation that you are 18 or older and in the auction's service area. We record the exact wording you agreed to, the date and time, your IP address, your browser type (user agent), and the verification code session that confirmed your phone number.
- Bids and pledges: the amounts you bid, your "I'm in at $___" participation pledges, and when you placed them.
- Winner and checkout details: if you win or buy an offer, your confirmed address and the result of the eligibility check. Your payment is processed by Stripe on the Business's account. We receive only payment status, amount and reference IDs, never your full card number.
- Messages you send us: replies to our texts or emails (including STOP, HELP or DELETE), support requests, and any other messages.
- Feedback and reviews: star ratings, comments, survey answers, and whether you gave permission for us or the Business to quote you.
- Pre-auction questions (some auctions only): answers to short questions about what result you want and what you'd be willing to bid.
2.2 Information collected automatically
- First-party analytics: pages viewed, buttons tapped, registration and bidding steps, and which version of a page you saw (we test page layouts and wording to improve the Service). We collect this ourselves; we don't use any third-party analytics service. It is tied to a random ID or a pseudonymous code, never to your name, email or phone number. See our Cookie and Analytics Notice.
- Device and connection data: IP address, browser type, and coarse location (country and region) derived from your IP. For analytics we shorten the IP address before use, and we never store the full address with analytics data.
- Security signals: bot-detection results (Cloudflare Turnstile), rate-limit counters, and fraud indicators such as unusual bidding patterns or VPN use.
- Message delivery data: whether our texts and emails were delivered, opened or clicked, and any opt-outs.
- Cookies and similar technologies: first-party cookies that keep you signed in on an auction site, remember your choices, and support analytics. Where a Business has advertising measurement turned on and you consent, a Meta Pixel cookie (see section 5).
2.3 Information from others
- The Business may give us information it already has about you, such as whether you completed a purchase or were contacted.
- Service providers such as Stripe (payment status), GoHighLevel (message delivery and opt-out status) and Cloudflare (security signals).
3. How we use your information
We use personal information to:
- Run auctions and your account:
- verify your phone number with a one-time code;
- check eligibility;
- accept and rank bids and pledges;
- show the public leaderboard;
- run the close, the 24-hour payment window and runner-up offers;
- deliver your participation gift.
- Send auction alerts you asked for: sign-up codes, registration confirmation, outbid, closing soon, winner and runner-up notices, forfeiture notices, price alerts (when you pledge in a falling-price auction), extension and cancellation notices, and results.
- Pass your details to the Business you registered with so it can follow up with you about the auction and related offers, as you agreed when you registered (section 4.1).
- Process payments through Stripe on the Business's account, and handle refunds when required (for example, if a winner turns out to be ineligible).
- Keep auctions fair and secure:
- detect bots, fake or shill bids and fraud;
- enforce our rules (including that a Business's own staff can't bid on its auctions);
- keep records of consent and opt-outs.
- Measure and improve the Service:
- understand which steps people find hard;
- test improvements to page layouts and wording;
- improve the tools that help Businesses plan auctions, such as starting prices and timing.
We do this using aggregated or de-identified information across many auctions. We never give one Business another Business's customer details. Auctions run by health-related Businesses are excluded from the lessons we share across Businesses.
- Send feedback requests about the auction and our platform.
- Comply with law and protect our rights, our users, and the public.
AI features. Nearbidly uses AI models (accessed through Cloudflare AI Gateway) to help Businesses write auction descriptions, follow-up messages and reports, and to summarize auction results. We do not include your phone number or email address in information sent to AI models. Bidders are referred to by pseudonymous IDs. We don't use AI to make decisions that produce legal or similarly significant effects about you. Location checks use a ZIP-code dataset we hold ourselves, not a third-party mapping service. Winner and eligibility decisions follow the published auction rules.
Legal bases (where applicable): we process information to perform our agreement with you (the auction terms), with your consent (texts, emails, advertising cookies), for our legitimate interests (security, fraud prevention, improving the Service), and to meet legal obligations.
4. How we share information
4.1 With the Business running the auction
When you register for an auction and agree to be contacted, we share your name, phone, email, ZIP or address, registration time, bids or pledge, rank, and consent record with that Business only. The Business uses it to deliver your gift, follow up with offers, and fulfill any purchase. A Business does not receive your information from auctions run by other Businesses.
4.2 With service providers
These providers work for us or for the Business under contracts that limit how they can use your information:
| Provider | Purpose |
|---|---|
| GoHighLevel (LeadConnector) | Sends our text alerts and verification codes, and holds the Business's CRM, from which its follow-up texts and emails are sent |
| Postmark (ActiveCampaign) | Sends Nearbidly's emails, such as email verification codes, auction alerts, sign-in links and receipts of your requests, and reports delivery, bounces and complaints |
| Stripe | Payment processing for prizes and offers (on the Business's own Stripe account) |
| Google Cloud | Hosting, databases, analytics storage (BigQuery) and scheduled jobs |
| Cloudflare | Website delivery, security, bot protection (Turnstile), and AI Gateway |
| AI model providers (through Cloudflare AI Gateway) | Generating text and summaries, with no phone numbers or emails included |
| Meta | Advertising measurement, only if the Business has enabled it and you accept advertising cookies. Never for health-related businesses by default. |
4.3 Text messaging data is never sold or shared for marketing
We do not sell, rent or share your mobile phone number, or your consent to receive text messages, with third parties or affiliates for their own marketing or promotional purposes. Text messaging opt-in data and consent are used only to send the messages you agreed to receive. The only exceptions are service providers that help us deliver those messages (such as GoHighLevel and the mobile carriers).
4.4 Other sharing
- Public auction display. The public leaderboard and live feed show only a short alias (first name and last initial, for example "Maria R."), your city, and your bid or pledge amount and time. We never show your phone number, email, full last name or address publicly.
- Legal and safety. We disclose information where required by law, subpoena or court order, or to protect the rights, property or safety of Nearbidly, our users or others.
- Business transfers. If we are involved in a merger, acquisition or sale of assets, information may transfer as part of that deal, subject to this policy.
- With your permission. Any other sharing happens only if you ask us to or agree.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising except Meta measurement when you have opted in through the cookie banner (see section 5). You can withdraw that consent at any time.
5. Cookies, analytics and advertising
- Necessary cookies keep you signed in on an auction site and protect against fraud.
- First-party analytics are collected by Nearbidly itself, with no third-party analytics scripts. Data is pseudonymous: your IP is shortened and no names, emails or phone numbers are stored. You can opt out on our Cookie and Analytics Notice page.
- Meta Pixel and Conversions API are used only if the Business has turned them on and you accept advertising cookies in our banner. When on, we send Meta limited event information (for example "registered" or "purchased") with hashed (scrambled) email or phone so the Business can measure its ads. For health-related businesses (such as dental, orthodontic, medical, chiropractic, mental health and veterinary), this is off by default and we never send details describing a treatment or condition.
- Global Privacy Control (GPC): we treat a GPC signal from your browser as a request to opt out of advertising cookies and the sale or sharing of personal information. Browser "Do Not Track" signals are also treated as an opt-out of advertising measurement.
6. Your choices
- Texts: reply STOP (or DELETE, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE or OPT OUT) to any text. Opting out of Nearbidly alerts does not opt you out of the Business's messages, and the reverse is also true. Reply STOP to each sender, or manage both from your account page. Reply HELP for help.
- Emails: click "unsubscribe" in any email.
- Analytics: opt out on the Cookie and Analytics Notice page.
- Advertising cookies: decline or withdraw consent in the cookie banner (available from the footer link).
- Testimonials: withdraw permission to quote you at any time (see the Review and Testimonial Terms).
7. Your privacy rights
Depending on where you live (including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, New Jersey and other U.S. states with privacy laws), you may have the right to:
- Know and access the personal information we hold about you, and receive a copy in a portable format.
- Correct inaccurate information.
- Delete your personal information.
- Opt out of the sale or sharing of personal information, targeted advertising and profiling. We do not sell personal information.
- Limit the use of sensitive personal information. We don't collect health information and don't use sensitive information to infer characteristics about you.
- Not be discriminated against for using these rights.
How to make a request. Email support@nearbidly.com with the subject "Privacy request", or use the request link on your account page. We verify requests by sending a one-time code to the phone number or email on your account. An authorized agent may submit a request with written permission, and we may still verify your identity directly. If we deny your request, you may appeal by replying to our decision. We will respond to an appeal within the time required by law.
What happens when you ask us to delete your information.
- Your profile: we remove your bidder profile. Your name becomes "Deleted bidder", and your phone and email are replaced with irreversible codes.
- Records we must keep: we keep records needed to prove your consent and honor your opt-outs (in coded form), and transaction records required by law.
- The Business's copy: we ask the Business you registered with to delete its copy. Each Business controls its own CRM and payment records.
We aim to complete deletions within 30 days.
California "Shine the Light": we don't share personal information with third parties for their direct marketing.
8. How long we keep information
| Information | How long |
|---|---|
| Bidder profile | While your account is active, plus 18 months of inactivity, then de-identified |
| Consent and opt-out records | 5 years after last use (kept in coded form after deletion) |
| Bids, pledges, awards and payment records | 5 years |
| Unprocessed bid attempts | 30 days |
| Sign-up code records | Until used, or up to 24 hours |
| Fraud and security flags | 2 years |
| Pre-auction question answers | 12 months |
| Feedback and reviews | 3 years. Published quotes are removed within 24 hours if you withdraw permission. |
| Analytics events (pseudonymous) | 25 months. Aggregated statistics with no identifiers are kept for 5 years. |
| Contacts in our alert system (GoHighLevel) | 18 months after your last auction activity |
| Audit and security logs | Up to 7 years |
| The Business's own records | Set by the Business |
9. Security
We protect information with:
- encryption in transit (HTTPS);
- encrypted storage;
- strict access controls, including separate access for each Business;
- secrets stored in Google Secret Manager;
- bot protection;
- audit logs;
- regular testing.
No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affects your information, we'll notify you as required by law.
10. Children
The Service is only for people 18 or older. Every bidder confirms this when registering. We don't knowingly collect information from anyone under 18. If you believe a minor has registered, contact us and we will delete the account.
11. Health information
Nearbidly does not ask for health information. If a health-related Business (for example, an orthodontist) runs an auction:
- the registration form collects only basic contact and eligibility details;
- advertising tracking is off by default;
- when you reply to a message, we don't store the text of your reply or send it to AI tools. We only check it for opt-out or help keywords;
- Nearbidly's own emails to you contain no health information.
Please don't share health details in auction comments, replies or feedback.
12. Where your information is processed
The Service is operated from the United States, and information is stored on U.S.-based infrastructure. If you take part from outside the U.S., your information will be transferred to and processed in the U.S.
13. Changes to this policy
We'll post any changes here and update the effective date. If changes are material, we'll notify you by email or on the Service before they take effect.
